Terms of Service

By accessing or using the OpsPilot platform, software agents, dashboard, control plane, APIs, or any related services (collectively, the “Service”) provided by 911 DevOps LLC (“911 DevOps,” “we,” “us,” or “our”), you (“Customer,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”).

If you do not agree to these Terms, do not access or use the Service. If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity.

OpsPilot is an AI-assisted DevOps automation platform. It consists of:

• A lightweight agent installed on Customer-owned or Customer-authorized servers;
• A hosted or self-hosted control plane that manages agents and dispatches jobs;
• A dashboard and API for issuing natural-language queries and viewing results;
• An AI reasoning layer that translates queries into diagnostic commands and explanations.

The Service is designed to assist trained professionals. It is not a substitute for qualified human judgment. All commands suggested or executed by the AI must be reviewed and accepted by the Customer.

You are solely responsible for ensuring you have full authorization to install and operate the OpsPilot agent on any target system. You represent and warrant that:

• You own, or have explicit written permission from the owner of, every system on which you install the agent;
• You have the legal right to execute automated commands on those systems;
• Your use of the Service complies with all applicable laws, regulations, and third-party agreements (including cloud provider terms, employer policies, and client contracts);
• You will not use the Service to access, probe, or modify any system without authorization;
• You will maintain the security of your API keys and session credentials and immediately notify us of any unauthorized access.

Any use of the Service on systems you do not own or are not authorized to administer is a material breach of these Terms and may constitute a violation of applicable computer fraud and unauthorized-access laws.

The Service uses AI language models to generate diagnostic commands and suggested remediations. You acknowledge and agree that:

• AI-generated output may be inaccurate, incomplete, or inappropriate for your specific environment;
• You assume full responsibility for reviewing, approving, and executing any command the Service suggests;
• 911 DevOps has no control over the AI models used as backends (Ollama, Amazon Bedrock, OpenAI, etc.) and is not responsible for their output;
• The safety enforcement layers within the Service (DENY lists, YAML policies, risk scoring) are risk-reduction tools, not guarantees — no software can prevent all possible harmful outcomes;
• 911 DevOps is not liable for any system damage, data loss, service interruption, security breach, or other harm arising from commands executed via the Service, regardless of whether those commands were AI-suggested or manually issued.

You agree not to use the Service to:

• Access, probe, or modify systems you are not authorized to administer;
• Conduct unauthorized penetration testing, vulnerability scanning, or reconnaissance;
• Circumvent, disable, or interfere with security features of the Service or any target system;
• Distribute malware, ransomware, or other malicious software;
• Violate any applicable law or regulation, including computer fraud, wiretapping, or privacy laws;
• Harass, harm, or discriminate against any individual or group;
• Resell or sublicense the Service without our written consent;
• Reverse-engineer, decompile, or attempt to extract the source code of the hosted Service components.

We reserve the right to suspend or terminate your access if we have reasonable grounds to believe you are violating this section.

You must provide accurate and complete information when creating an account. You are responsible for all activity that occurs under your account credentials. You must immediately notify us at legal@911devops.com if you suspect unauthorized use of your account. We are not liable for losses caused by unauthorized use of your account.

All plans (Basic, Pro, Elite) are billed monthly via Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Basic includes a free trial period; your payment method is authorized at signup but not charged until the trial ends, and cancelling before the trial ends results in no charge at all.

You may cancel at any time, self-service, from the dashboard (Manage → Plan → Manage Billing), which opens Stripe’s secure billing portal. Cancellation takes effect at the end of your current billing period or trial period — you keep access until that date, and the subscription will not renew or charge again after it. No refunds are issued for partial billing periods unless required by law. Once your access period ends, your account is deactivated; agents stop functioning and data associated with your account is retained per our Privacy Policy’s retention terms, not immediately deleted.

We reserve the right to change pricing with 30 days’ notice to active subscribers.

The Service, including all software, documentation, trademarks, and content, is owned by 911 DevOps or its licensors. Open-source components are governed by their respective licenses. These Terms do not grant you any ownership interest in the Service.

You retain ownership of all data, configurations, and content you submit to the Service. You grant us a limited license to process that data solely to provide the Service to you.

The service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or uninterrupted availability. We do not warrant that the service will be error-free, secure, or that any defects will be corrected.

Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions, our warranties are limited to the minimum scope permitted by law.

To the fullest extent permitted by applicable law, 911 DevOps and its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, system damage, business interruption, or cost of substitute services, arising from or related to your use of or inability to use the service, even if advised of the possibility of such damages.

Our total aggregate liability for all claims arising from or related to these terms or the service shall not exceed the greater of (a) the total amounts paid by you to us in the twelve (12) months preceding the claim or (b) one hundred US dollars ($100).

You agree to defend, indemnify, and hold harmless 911 DevOps and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; or (d) any unauthorized installation of the agent on systems you do not own or control.

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice, including for violations of these Terms. You may cancel your account at any time from the dashboard. Upon termination, your right to use the Service ceases immediately. Sections 4, 9, 10, 11, and 13 survive termination.

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Binding Arbitration. Any dispute, claim, or controversy arising from these Terms shall be resolved by binding individual arbitration administered by JAMS (Judicial Arbitration and Mediation Services) under its Streamlined Arbitration Rules & Procedures (claims under $250,000) or its Comprehensive Arbitration Rules & Procedures (claims of $250,000 or more). Arbitration shall be conducted in English, with the seat of arbitration in Los Angeles County, California, or remotely by videoconference if both parties agree.

Class Action Waiver. You and 911 DevOps agree that each may bring claims only in your or its individual capacity and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not preside over any representative proceeding.

Jury Trial Waiver. You and 911 DevOps waive any right to a jury trial for any dispute.

For matters not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California. Nothing in these Terms limits your rights under applicable California consumer protection laws, including CCPA/CPRA, to the extent those rights cannot be waived by contract.

We may update these Terms at any time. We will provide at least 30 days’ notice by email or in-app notification before material changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
